Specifying Health / Financial Wishes
We specialise in dealing with complex and high-value financial claims upon divorce (known as “ancillary relief” claims). These include claims for maintenance, lump sums, transfers of property and pension-sharing orders.
If you are unmarried and own a property jointly, we can help you negotiate a settlement with your partner regarding the division of property in the event of the relationship breaking down. If it is not possible to reach agreement, we can represent you in proceedings under the Trusts of Land and Appointment of Trustees Act 1996 to apply to the court for an order for sale of a property and for the court to determine your share in the property.
We can also assist you in resisting an application for an order for sale brought by your former partner. You may have an interest in a property despite not being a legal owner, which we can advise you on.
We also help you to make applications to the court for financial provision for your children under the Children Act 1989.
