Company X sought our representation to help them recover the costs they had incurred from a former commercial tenant, where the tenant left a property in a state of disrepair. The value of the works was around £900,000, with further consequential losses. This was a matter where consideration had to be given to the statutory cap under section 18 of the Landlord and Tenant Act with experts reports being required. Proceedings were issued but a negotiated settlement was achieved. By the time we reached settlement in this case the dispute essentially came down to the differing figures achieved by the expert on the diminution in value. A favourable outcome was achieved for our client.
