Dealing with financial settlement many years after separation
A client had been separated from his wife for over ten years but divorce and financial matters had never been resolved. He had vacated the family home and allowed his wife to reside there with the children. She had gone on to then have children with a new partner, and her new partner lived with her in the former matrimonial home. Our client had been very patient in waiting until the parties’ children were older before seeking his share of the property. His wife and her new partner were refusing to co-operate and ignored all attempts to resolve matters. We therefore brought financial proceedings whereupon it became apparent that our client’s wife and her new partner were in a position to take over the mortgage and buy out our client at a lump and he was very happy with this as we ensured this was assessed at current value and not at the time he left as argued by the other side.
