Ministry of Justice Proposes Further Court Fee Increases

On 22 July 2015 the Ministry of Justice proposed further increases for issuing money claims with the maximum fee likely to be at least £20,000.

This follows the increases brought into force in March 2015 which saw the maximum fee for issuing a claim increase to £10,000 - causing much controversy. The new increases will only affect claims in excess of £200,000. The Ministry of Justice also confirmed that it will increase court fees for issuing general applications and possession claims.

The introduction of further fee increases will strike fear in the hearts of claimants and solicitors alike. There is a real risk that genuine claimant will be deterred from bringing claims where they are unable to fund the issue fees.

“The proposed increases represent a further hurdle for claimants in gaining access to justice. Take, for example, a claim brought by an individual on a legal expenses insurance funded basis. - they will still be required to pay the court fee up front, albeit they will later be reimbursed, and for a claim of £300,000 a fee of £15,000 will be payable.”

“This is devastating news for claimants and the litigation profession as a whole because it will likely deter many genuine claimants from bringing claims and put pressure on firms to take on claims under Conditional Fee Agreements”
