Banking Scams

The recent imprisonment of fraudsters behind telephone banking scams has highlighted how criminals target the elderly and vulnerable.  In some cases victim are persuaded to make online or telephone banking transfers to accounts by telling the victim that the funds are at risk. In other cases people have been into bank branches to withdraw or transfer funds, or a courier has collected a bank card from the victim’s home.

Expert Commentary

Samantha Hamilton, head of the Private Client department at Mullis & Peake LLP, said:

“It is appalling that criminals target the most frail and vulnerable in society, in some cases taking the victim’s entire life savings.  The funds stolen have been used in organised crime and terrorism.  I act for a large number of clients, where I have been appointed as Deputy by the Court of Protection, or as Attorney under a Lasting Power of Attorney.  Many clients are reassured by the fact that if they are contacted about a bank account or other financial matters, they can simply say that they need to speak to their Attorney/Deputy/Solicitor before entering into any conversation.  This frequently has the desired effect, as the scammers quickly end calls when it is clear that a third party is supporting the potential victim.

For anyone worried that they are vulnerable, or for friends and family of someone who may be targeted in these types of scams, having appointed an Attorney under a Lasting Power of Attorney means that they have someone to assist them, and a line of defence against fraudsters.

I would repeat the police advice to never reveal a card PIN or provide an online banking authorisation code to anyone calling and claiming to be from your bank.  If there is a suggestion that you put the phone down and call the number on your bank card, try to call from another phone, such as a mobile phone, as the fraudsters sometimes stay on the line and pretend to be bank staff.  If there is a genuine issue relating to your bank account, the bank staff will never be concerned about you speaking to a friend, family member or neighbour for support.”

For advice on Lasting Powers of Attorney or applications to the Court of Protection for the appointment of a Deputy please contact the Court of Protection team.
