What are pre-contract enquiries and why do they matter?

In the conveyancing process, enquiries are the questions your solicitor asks the seller’s solicitor after reviewing the contract pack, title deeds, and search results in respect of missing information or documentation. They are to gather more detail about the property and identify any potential issues that might affect your decision to proceed.

Enquiries can cover a wide range of topics, such as:-

• clarifying who is responsible for boundary fences or shared driveways
• ensuring building work had the correct planning permission or building regulation approval
• obtaining guarantees, such as for damp proofing or double glazing
• investigating rights of way or restrictive covenants
• checking for any ongoing disputes with neighbours or service providers
• finding out more information regarding any insurance claims

For leasehold properties, enquiries may also include information about service charges, ground rent, the managing agent, and any upcoming major works.

Your solicitor acts as your legal safeguard, making sure everything is fully understood before you commit.

The enquiries relate to the legal title and not the condition of the property as this is the remit of the buyer’s surveyor.
