Thinking about remortgaging your property?

To remortgage a property is to look to move one mortgage deal to another to be secured against the same property. This often means replacing one high street lender for another.

Alternatively, you may look to simply mortgage your property by raising mortgage finance against a property you currently own. This could be by first and only mortgage or by way of a second mortgage in which case the first mortgage lender’s consent may well be required.

Mortgage lenders require solicitors to act on their behalf to check the legal title to property and protect their security. Here at Mullis & Peake LLP we are on the panel of most mortgage lenders and can therefore act for both client and lender simultaneously.

Our instructions from lenders require us to not only check ownership of the legal title and to check the to title itself, for example, to ensure that the property has all appropriate rights and that are no issues which may affect the lender’s security such as a lease with very few years of the lease term remaining or a restriction on the use of the property but also to put searches in hand to ensure that there is nothing contained in public records which may affect the value of the property and the lender’s security.

As solicitors we will check the title, put in hand searches and report to both client and lender throughout.
