Holly Minney

Holly joined the firm in 2008 as a trainee before qualifying in January 2010 into the litigation department initially working mainly on personal injury matters. She was promoted to Senior Associate in 2018 and to Head of Dispute Resolution in 2020 and to ordinary Member in December 2020.

Holly has a LLB from the University of Kent, LPC from College of Law, London and a Post Graduate Diploma in Sports Law. In 2013 Holly obtained her Higher Rights of Audience for the Civil Courts.

As a litigation solicitor, Holly has extensive expertise in wide range of disputed matters, including commercial and residential property, debt, contract, and business disputes. As well as personal injury.

She has a particular interest in property litigation, especially in respect to commercial property. Holly has represented a number of commercial clients in disputed dilapidations claims and forfeiture proceedings. Holly also has a keen interest in dealing with company disputes especially those between shareholders and directors. Holly also deals with application to court where errors have been made with Companies House filings.

Holly has a no-nonsense approach with the ability to simplify matters to the key points to allow clients to better understand the matters without drowning them in legal jargon. She is very analytical and good at working within a team environment.

Case summaries

• Holly has represented a multi-national corporate client in respect to dilapidations claim in relation to an office building, where the extent of the dilapidation was valued in excess of £1 million. Proceedings were issued but a settlement was reached, and payment received by our clients.
• She has acted for a commercial client with an extensive portfolio on numerous matters including the eviction of squatters from a commercial premises. The squatters took up occupation when the property was on the market for leasing, an interim possession order was obtained quickly, and the squatters were removed by private enforcement agents. Post eviction security was required as the squatters had suggested they would return once the Property was empty.
• Holly has been involved in a locally high-profile forfeiture claim, where the outgoing tenants were trying to use Facebook to garner support for their position and were posting dishonest information about the landlord and their lease. Court proceedings were required to be issued, as the tenants had what they called ‘on sight security’ staying at the premises and hence prevented the landlord from peaceable re-entering. A possession order was obtained, and the enforcement agents were able to enter and secure the site.
• Acting for a director and shareholder of a family company, Holly was involved where a dispute arose between the shareholders. A claim for Unfair Prejudice was issued by the other shareholder, the claim was robustly defended. A favourable settlement was agreed at mediation. Our client now retains full control of the company.
• She acted for a shareholder in a claim against the other shareholders for unfair prejudice. Our client had been a shareholder of the company for a number of years, since his appointment the company had ceased to pay dividends and had substantially increased payments to directors. Settlement was agreed by mediation with our client shares being bought out and our client making a substantial profit on the initial investment.

Outside of Work

Holly spends most of time running around with her daughters and taking them to sporting activities.

Holly particularly enjoys playing netball, having represented England at Under 19 and Under 21 level, and continues to play locally as well as coaching at junior level.  Holly also plays cricket.
