Those that have not obtained serious injuries might have returned to work and in all cases, they are adapting to a new life with the injuries they have sustained. Here are our top tips for managing a personal injury claim:

Take pictures

Taking pictures of the exact location where your accident occurred and having a way to measure the defect which caused your accident will help your personal injury claim. For example, if you have tripped on a pavement slab, placing your house or car keys against the gap in the pavement will help highlight how large the defect is. It’s also important to take clear pictures of any injuries you have sustained at the time of incident and weeks after. Insurers regularly ask for photographs of the injury.

Keep records

Make sure records are kept of all GP and hospital appointments which you have attended as a result of the injury. This will include any medication you have been prescribed which you have paid for and any treatment you have had. Keeping records of the costs, you have also incurred as a result of your injury ensures that if and when the quantum stage of your case is reached, you will have all the evidence needed to show the losses you have incurred.

Do not post on social media about your case

Insures can check your social media accounts as part of their investigation and this is becoming more common. Without knowing it, you might say or do something that has the potential to jeopardise your claim. For this reason, it is best to avoid talking about your claim on social media and in any case, it is important to keep your accounts private.

Expectation management

Personal injury claims can take months, and with serious injuries, years to conclude. In the initial stages, it can take a while for parties to respond to each other whilst they are investigating the claim. Once medical experts have been instructed, it can take weeks for them to review your medical records and advise on your injury.  Even in cases where serious injury has occurred, claimants should not wait on the conclusion of the case to progress certain aspects of their lives. It is important to trust the process and be patient.

Listen to the advice given

Your solicitor and the medical experts will be experienced professionals who would have investigated a number of injuries and dealt with many claims. They will be best placed to advise you on your claim and they will have your best interests in mind. In cases where doctors have advised on certain treatment plans, you should follow the recommendations to assist in your recovery.
