Partnership Disputes

What to do when there is a dispute between business partners

Disputes between business partners can occur for any number of reasons. The typical structure of a business partnership and a limited liability partnership (LLP) gives all partners equal rights and authority within the organisation. When a dispute occurs between partners, therefore, it can be difficult for them to resolve the conflict between themselves.

The most common causes of conflict include a breakdown in the working relationship, or an existing partner wishing to leave the partnership. In some cases, they may even be compelled to leave by an existing partner.

Do you need help with the following?

  • alleged breaches of the firm's partnership or LLP members' agreement
  • disputes relating to partnership accounts and valuation issues
  • enforceability of restrictive covenants
  • partner expulsions and compulsory retirements
  • partner/employee’s status issues

Due to the complex and personal nature of many business partnerships, these disputes need to be dealt with sensitively in order to find the most reasonable outcome. Unfortunately, this can’t always be achieved in the privacy of the boardroom.
